Service Limitations

• Ambisius is designed for small business applications and may not be suitable for enterprise-level operations
• We follow a "start small, build up" philosophy—the Service is designed for incremental growth
• Some features may be in beta or "Coming Soon" status and are subject to change
• Service availability may vary by region

Account Creation

• You may browse and explore Ambisius without creating an account
• To use the full Service, you must register by providing a valid phone number (WhatsApp) or email address
• You must be at least 18 years old or the age of majority in your jurisdiction to create an account
• If you represent a business, you warrant that you have authority to bind that business to these Terms

Account Security

• You are responsible for maintaining the confidentiality of your login credentials
• You agree to notify us immediately of any unauthorized access to your account
• You are responsible for all activities that occur under your account
• We reserve the right to suspend or terminate accounts that we suspect have been compromised

Account Information

• You agree to provide accurate, current, and complete information
• You agree to update your information promptly if it changes
• We may verify your information and suspend your account if we cannot verify your identity

Acceptable Use

You agree to use Ambisius only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service for any illegal activities or to violate any laws
• Impersonate any person or entity or misrepresent your affiliation
• Upload or transmit viruses, malware, or any malicious code
• Attempt to gain unauthorized access to our systems or other users' data
• Use the Service to harass, abuse, or harm others
• Scrape, crawl, or use automated systems to access the Service without permission
• Reverse engineer, decompile, or attempt to extract source code
• Use the Service to create competing products or services
• Upload content that infringes intellectual property rights of others
• Store or transmit prohibited content (see Section 4.2)

Prohibited Content

You may not use Ambisius to store, process, or transmit:

• Illegal content or content that promotes illegal activities
• Content that violates intellectual property rights
• Malicious code, viruses, or harmful software
• Personal data of individuals without proper consent
• Content that is defamatory, obscene, or offensive
• Content related to weapons, drugs, or other regulated goods (unless legally authorized)
• Spam, phishing attempts, or fraudulent content

Your Data and Content

• You retain all ownership rights to the data and content you input into your applications
• You are solely responsible for the accuracy, legality, and appropriateness of your data
• You represent and warrant that you have all necessary rights to use and share your data
• You must comply with all applicable data protection and privacy laws

Ambisius Property

• The Service, including all software, features, technology, and "building blocks," is owned by Ambisius
• Our trademarks, logos, and brand elements are protected intellectual property
• You receive a limited, non-exclusive, non-transferable license to use the Service
• This license does not grant you any ownership rights to the underlying platform

Your Applications

• You retain ownership of the applications created using Ambisius
• However, applications are built using our proprietary building blocks and infrastructure
• You may not export or migrate your application structure to competing platforms
• Upon termination, your license to use the platform infrastructure ends

Feedback and Suggestions

• If you provide feedback, suggestions, or ideas about Ambisius, we may use them freely
• You grant us a perpetual, worldwide, royalty-free license to use any feedback you provide
• We are not obligated to implement any feedback or provide compensation

Free Tier

• Ambisius offers a free tier with basic features at no cost
• Free tier usage is subject to fair use limitations
• We may modify or discontinue the free tier with 30 days' notice

Paid Plans

• Advanced features require a paid subscription
• Pricing is displayed on our website and is subject to change
• All prices are shown in Indonesian Rupiah (Rp) unless otherwise stated
• Prices do not include applicable taxes unless specified

Billing and Payments

• Paid subscriptions are billed on a recurring basis (monthly or annually)
• You authorize us to charge your payment method on each billing cycle
• Payment is due immediately upon subscription
• Failed payments may result in service suspension or termination
• You are responsible for all applicable taxes

Refunds and Cancellations

• You may cancel your subscription at any time
• Cancellations take effect at the end of the current billing period
• No refunds are provided for partial billing periods unless required by law
• If you cancel, you retain access to paid features until the end of your billing period

Price Changes

• We may change our pricing with 30 days' advance notice
• Price changes apply to new billing cycles
• Continued use after price changes constitutes acceptance

Privacy Policy

• By using Ambisius, you consent to our Privacy Policy

• However, no system is 100% secure—use the Service at your own risk

Your Data Responsibilities

• You are responsible for compliance with data protection laws (including GDPR, Indonesian data protection regulations, etc.)
• You must obtain necessary consents to collect and process personal data
• You must not store sensitive personal data without implementing appropriate safeguards
• We are a data processor; you are the data controller for your business data

Data Location

• Your data may be stored and processed in various locations worldwide
• We use reputable cloud infrastructure providers
• Data location information is available upon request

Service Availability

• We strive for 99.5% uptime but do not guarantee uninterrupted service
• Scheduled maintenance will be communicated in advance when possible
• We are not liable for service disruptions beyond our reasonable control

Service Modifications

• We will provide reasonable notice for material changes affecting paid features
• Beta features and "Coming Soon" features are provided as-is and may change significantly

Updates and Maintenance

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
• WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED
• WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OR AI-GENERATED FEATURES

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
• FOR FREE TIER USERS, OUR MAXIMUM LIABILITY IS RP100.000
• WE ARE NOT LIABLE FOR:

• Loss of profits, revenue, or business opportunities
• Loss of data (beyond restoration from backups)
• Third-party actions or content
• AI-generated recommendations or features that don't meet your expectations

Exceptions

Nothing in these Terms excludes liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded under Indonesian law

AI Consultancy

• Our AI consultancy feature provides automated suggestions and app generation
• AI-generated features are based on your inputs and may require refinement
• We do not guarantee that AI recommendations will perfectly match your needs
• You are responsible for reviewing and testing AI-generated features before use

Quality Assurance

• While we state that Ambisius uses "well-tested building blocks," we do not guarantee bug-free operation
• We follow software engineering best practices but cannot eliminate all risks
• You should thoroughly test your applications before relying on them for critical business operations

Rollback and Changes

• We offer rollback capability for feature changes
• Rollback availability may be limited to recent changes
• Some changes may not be reversible due to data dependencies

Team Members

• You may invite team members to access your applications (feature availability varies by plan)
• You are responsible for all activities of your team members
• You must ensure team members comply with these Terms
• You may set permission levels for team members

Data Sharing

• When you invite team members, you authorize them to access shared data
• You are responsible for managing access and removing team members when appropriate
• We are not liable for unauthorized access resulting from your permission settings

Public-Facing Applications

• Some features allow you to create customer-facing interfaces
• You are solely responsible for compliance with consumer protection laws
• You must provide appropriate terms and privacy policies to your customers
• We are not a party to transactions between you and your customers

E-Commerce and Transactions

• If you process payments or transactions through your applications, you must comply with applicable laws
• You are responsible for payment processing, refunds, and customer disputes
• We do not process payments on your behalf unless explicitly stated

Termination by You

• You may terminate your account at any time through the Service settings
• Upon termination, you lose access to paid features immediately unless you've paid for the current period
• You may export your data before termination (export features subject to your plan)

Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• You fail to pay applicable fees
• Your account is used for illegal activities
• We are required to do so by law
• Your use poses a security risk to our Service or other users

Effect of Termination

• Upon termination, your license to use the Service ends immediately
• We may delete your data after a reasonable retention period (typically 30-90 days)
• You remain liable for any outstanding fees
• Sections that should survive termination (including limitations of liability) remain in effect

Governing Law

These Terms are governed by the laws of Indonesia, without regard to conflict of law provisions.

Dispute Resolution Process

• Before filing a legal claim, you agree to contact us to seek an informal resolution
• We will attempt to resolve disputes through good-faith negotiation
• If informal resolution fails, disputes will be resolved through arbitration or the courts of Indonesia

Arbitration

• Each party bears their own costs unless the arbitrator decides otherwise

Class Action Waiver
